"Resurge," the Resurge logo, and other marks are trademarks of Resurge Innovations Inc. You may not use these trademarks without our prior written permission.

3.1 AI-Powered Services

Our Services may include AI-powered features and tools. You acknowledge that AI systems may produce unexpected or inaccurate results, and you use these features at your own risk. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

3.2 Training and Improvement

We may use anonymized and aggregated data from your use of our Services to train and improve our AI models and Services, subject to our Privacy Policy. We will not use your confidential or proprietary information for this purpose without your explicit consent.

4.1 Fees

Access to certain Services may require payment of fees. You agree to pay all fees associated with your subscription or use of paid Services. All fees are non-refundable unless otherwise specified or required by law.

4.2 Billing

If we cannot resolve a dispute informally, any dispute will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in the United States, and judgment on the arbitration award may be entered in any court having jurisdiction.

8.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10.2 Entire Agreement

These Terms constitute the entire agreement between you and Resurge Innovations Inc regarding the use of the Services and supersede all prior agreements and understandings.

10.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

10.4 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

10.5 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

10.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, or governmental actions.
